Marketplace Agreement
Terms of Service
These terms govern customer, welder, and visitor use of WeldBooker. By creating an account or using the marketplace, you agree to them.
Effective October 2, 2026
1. Marketplace role
WeldBooker provides technology that helps customers describe welding work, compare welder responses, communicate, schedule, pay, and maintain a project record. WeldBooker is not the employer, contractor, agent, insurer, or supervisor of any customer or welder. Welders operate independent businesses and control how they perform accepted work.
2. Accounts and eligibility
You must be at least 18, provide accurate information, safeguard your sign-in credentials, and use one account only for the role assigned to it. You are responsible for activity under your account. WeldBooker may require identity, business, credential, insurance, or payment verification and may restrict accounts that cannot be verified.
3. Jobs, quotes, materials, and scheduling
Customers must describe the work, site conditions, desired dates, access, and known hazards accurately. Welders must review the scope before quoting and must identify assumptions, exclusions, added materials, or price changes through WeldBooker’s documented quote or change-order controls. Unless the parties document otherwise in WeldBooker, the welder is responsible for ordinary tools, consumables, and materials required by the accepted scope.
4. Payments and platform fees
Payments are processed by Stripe under its own terms. WeldBooker may collect a disclosed marketplace fee and allocate estimated processing costs as shown before checkout or quote acceptance. Customer funds may be held while work is active. A customer may separately approve an early release from secured job funds for documented raw materials; any released amount is deducted from the welder’s final completion payout and may limit an automatic cancellation refund. The remaining welder payout becomes eligible only after the platform’s completion, review, dispute, and connected-account requirements are satisfied. Users may not use platform communications to evade fees or move an introduced job off-platform.
5. Completion, disputes, and cancellations
Welders must update job status truthfully. Customers must review completion promptly and either confirm the work or report a specific issue through the platform. Cancellation, refund, chargeback, and change-order handling follows the published Cancellation & Refund Policy, which is incorporated into these terms.
6. Safety, credentials, and insurance
Users must follow applicable laws, permits, codes, hot-work controls, fire-watch requirements, and the WeldBooker Safety & Marketplace Standards. Profile badges or uploaded records indicate information provided or reviewed at a point in time; they are not a warranty of competence, coverage, licensure, or current legal compliance. Customers should independently confirm requirements appropriate to the job.
7. Prohibited conduct
You may not commit fraud, impersonate another person, harass or discriminate, submit unsafe or unlawful work, manipulate reviews, introduce malware, scrape the service, bypass access controls, abuse promotions, disclose private contact or payment details to evade the platform, or interfere with other users or WeldBooker systems.
8. Content and communications
You retain ownership of content you submit. You grant WeldBooker a worldwide, non-exclusive license to host, reproduce, format, and display that content as needed to operate, secure, promote, and improve the service. Messages may be screened for safety, fraud, off-platform payment, and contact-information violations.
9. Suspension and termination
WeldBooker may investigate, limit, suspend, or terminate access when reasonably necessary to protect users, comply with law, address nonpayment, or enforce these terms. Obligations relating to fees, disputes, ownership, liability, and records survive termination.
10. Disclaimers and liability
The service is provided “as is” and “as available.” To the fullest extent permitted by law, WeldBooker disclaims implied warranties and is not liable for indirect, incidental, special, exemplary, or consequential damages, lost profits, or worksite losses caused by independent users. WeldBooker’s aggregate liability for a claim will not exceed the greater of $100 or the platform fees paid to WeldBooker for the transaction giving rise to the claim.
11. Indemnification
You agree to defend and indemnify WeldBooker and its personnel from claims arising from your work, site, content, legal violations, breach of these terms, or interactions with another user, except to the extent caused by WeldBooker’s own unlawful conduct.
12. Governing law and contact
Florida law governs these terms, without regard to conflict-of-law rules. Before filing a claim, contact admin@weldbooker.com and allow 30 days for an informal resolution. WeldBooker may update these terms prospectively and will post the effective date here.
